    Details of Will/Living Trust Documents

    Durable/Financial Power of Attorney
(Included in Will Plan and Living Trust Plan. Free for ARAG members, and discounted 10% for non-ARAG KAW members.)
A power of attorney is a written authorization to represent or act for another person. It includes private matters, business or other legal issues. A "durable" power of attorney simply means that the document stays in effect if you become unable to handle matters on your own. A "financial" power of attorney gives someone the authority to handle financial transactions on your behalf.
    Healthcare Power of Attorney
(Included in Will Plan and Living Trust Plan. Free for ARAG members, and discounted 10% for non-ARAG KAW members.)
A document that names who will make healthcare decisions for you if you are unable to make decisions for yourself.
Living Will (also known as a Health Care Directive)
(Included in Will Plan and Living Trust Plan. Free for ARAG members, and discounted 10% for non-ARAG KAW members.)
Health Care Directives, Right to Die, and/or Medical Care Directive. This document provides guidance for your health care agent and doctors regarding your medical treatment preferences.
    Wills/Codicils
(Included in Will Plan and Living Trust Plan. Free for ARAG members, and discounted 10% for non-ARAG KAW members.)
A document in which a person specifies the method of distribution and the representative in charge of distribution of the person's estate after their death.
    Revocable Trust (Living Trust)
(Included only in Living Trust Plan. 25% off on hourly rate for ARAG members, 10% off flat rate fee for non-ARAG KAW members.)
A Living Trust is an alternative for a Will. The main benefit of a Living Trust is that it can prevent the need for probate (the process of going through the court system) when someone passes away. This can result in an expedited estate administration meaning your beneficiaries can receive their assets in a timely manner. Two additional benefits of a Living Trust are that, unlike a Will, it provides privacy because a Living Trust is not a matter of public record upon death and it can provide estate creditor protection.
